Competition Law

We advise Swiss companies belonging mainly to international luxury groups in relation to issues of competition law regarding distribution networks they set up (vertical agreements).

We also advise Swiss companies in the area of potentially unlawful restrictions to competition which can take the form of horizontal agreements (notably agreements fixing prices or providing for a geographic partitioning of markets). We have, in this respect, developed a special expertise in the area of parallel imports.

Finally, in relation to the mergers and acquisitions activities developed by the Firm, we of course advise our clients in relation to businesses concentrations under various forms : mergers, shareholdings, joint ventures, among others.

The services provided by our Firm also include the representation of our clients before the competition authorities.

Our practice includes the following elements in particular :

  • Advice related to distribution agreements, including selective distribution
  • Advice in relation to licensing
  • Analysis of horizontal agreements (price fixing or geographical restrictions)
  • Parallel imports
  • Businesses concentrations
  • Representation before competition authorities
